General Administration of Customs Announcement No. 75 of 2024 (Announcement on the Inspection and Quarantine Requirements of Brazilian Pecan Fruit exported to China)
According to China's laws and regulations and the provisions of the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture and Animal Husbandry of the Federal Republic of Brazil on the inspection and quarantine and health requirements of pecan fruits exported to China, from now on, the import of Brazilian pecan fruits that meet the following requirements is allowed:
I. Basis for inspection and quarantine
(1) The Food Safety Law of the People's Republic of China and its implementing Regulations, the Import and Export Animal and Plant Quarantine Law of the People's Republic of China and its implementing Regulations, the Import and Export Commodity Inspection Law of the People's Republic of China and its implementing Regulations.
(2) Measures of the People's Republic of China for the Administration of Import and Export Food Safety.
(3) Protocol between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture and Animal Husbandry of the Federal Republic of Brazil on Inspection and Quarantine requirements of Brazilian Pecan fruit exported to China.
2. Products that are allowed to be imported
Permitted import of Brazilian pecan refers to nuts for human consumption made from the mature fruits of Caryaillinoensis (Wangenh.) K. K. och, a thin-shelled pecan grown in Brazil, which have been selected, shelled, dried and processed in Brazil.
3. Food safety requirements
The export of Brazilian pecan fruit shall comply with China's food safety laws and regulations and national food safety standards.
4. Plant quarantine requirements
No live insects, eggs, soil, and impurities such as weed seeds, plant residues, gravel and metal foreign bodies shall be mixed with the fruit.
5. Requirements of production enterprises
Brazilian pecan fruit production enterprises shall ensure that their exports of Pecan fruit comply with China's food safety and phytosanitary laws and regulations and China's national food safety standards. The production, processing and storage units of Pecan fruit exported to China are recommended by the Ministry of Agriculture and Animal Husbandry of the Federal Republic of Brazil (hereinafter referred to as the Brazilian side) and registered by the General Administration of Customs of the People's Republic of China (hereinafter referred to as the Chinese side).
6. Processing requirements
The whole process of planting, production, processing, storage, transportation and export of raw materials exported from Brazil shall meet the relevant safety and health requirements of China and Brazil to prevent pollution by pathogenic microorganisms or toxic and harmful substances.
7. Packaging and marking requirements
Brazilian exports to China should be packaged in new, clean, sanitary, breathable materials that meet food safety and phytosanitary requirements, and prevent leakage during transportation. Each package should be marked with "This product is exported to the People's Republic of China", as well as the product name, origin, name of the production and processing enterprise and its registration number in China, the name and address of the exporter and other traceability information in Chinese or English. The above information can be affixed to the package in the form of a label.
8. Transportation requirements
Before the shipment of Huapieng fruit exported from Brazil, the Brazilian side shall inspect the transport vehicles transporting Huapieng fruit. The means of transport shall meet the sanitary and epidemic prevention requirements and shall not mix quarantine pests or other restricted quarantine objects, such as miscellaneous grass seeds, living insects, plant residues, soil and other foreign impurities.
9. Certificate requirements
After the official inspection and quarantine, the Pakistani side shall issue a phytosanitary certificate to the pecan fruits approved for export to China. The additional declaration column of the certificate shall indicate the name of the production and processing enterprise of the pecan fruit, the registration number in China, and "the Pecan fruit certified by the phytosanitary certificate conforms to the requirements of the Protocol on inspection and quarantine requirements of the Brazilian Pecan fruit exported to China signed by China and Brazil."
10. Other requirements
Brazilian exports should come from companies registered in China. The list of registered Brazilian exporters can be found on the website of the General Administration of Customs.
