Announcement on Quarantine Requirements for Importing Fresh-ripened Bananas from Peru
In accordance with relevant laws and regulations of China and the regulations on phytosanitary requirements for the import of Peruvian fresh-cut bananas from the National Plant Quarantine Bureau of the Ministry of Agriculture and Irrigation of the Republic of Peru (hereinafter referred to as the Peruvian side), as well as the agreements between the General Administration of Customs of the People's Republic of China (hereinafter referred to as the Chinese side) and the Ministry of Agriculture and Irrigation of the Republic of Peru on phytosanitary requirements, starting from now on, Peruvian fresh-cut bananas that meet the following requirements are allowed to be imported.
I. Basis for Inspection and Quarantine
(1) "The Law of the People's Republic of China on Biosecurity"
(2) The "Regulations on the Entry-Exit Inspection and Quarantine of Animals and Plants of the People's Republic of China" and its implementing regulations;
(3) The "Food Safety Law of the People's Republic of China" and its implementing regulations;
(4) "Measures for Inspection and Quarantine Supervision of Imported Fruits"
(V) "Agreement between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture and Irrigation of the Republic of Peru on Phytosanitary Requirements for the Export of Peruvian Bananas to China."
II. Permitted Names of Imported Goods
Fresh bananas (hereinafter referred to as "bananas"), scientifically known as Musa spp., are commonly called "Banana" in English. They are only the unripe and uncracked green bananas.
III. Allowed Place of Origin
Peruvian banana-growing area.
IV. Approved orchards and packaging plants
The banana orchards and packaging plants for export to China must undergo a secret formula review and be approved and registered by the Chinese side. The registration information includes the name, address and identification number, so as to enable accurate traceability in case the exported goods do not comply with the relevant regulations of this announcement. Before each export season, the secret formula should provide the registration list to the Chinese side.
V. List of Quarantine-Preventive Pests of Concern to China
1. Spiral aphid Aleurodicus dispersus
2. New Pineapple Scale Insect Dysmicoccus neobrevipes
3. Palm woodborer Beetle Rhynchophorus palmarum
4. Spiny Shield Scale Selenaspidus articulatus
5. Banana bacterial wilt pathogen strain 2 (Ralstonia solanacearum race 2)
VI. Pre-export Management
(1) Orchard Management.
1. The orchards exporting to China should establish and implement Good Agricultural Practices (GAP) to ensure the traceability of the production process; maintain the sanitary conditions of the orchards, remove rotten, diseased and cracked fruits during harvest, and implement Integrated Pest Management (IPM), including pest and disease monitoring, chemical or biological control measures, and agricultural operations for prevention and control.
2. The orchards exporting to China should implement effective pest monitoring and integrated pest control measures under the supervision of the secret formula, in order to prevent the occurrence of quarantine pests of concern to China.
3. The phytosanitary measures for orchards exporting to China must be implemented under the guidance of technical personnel who possess knowledge of pest control and monitoring in plant quarantine. These technical personnel should undergo training provided by the Secretariat or its authorized institutions.
4. The orchards exporting to China should keep records of pest monitoring and control measures, and should be required to provide these records to the Chinese side. The control records should include detailed information such as the names, active ingredients, application dates and dosage concentrations of all chemical agents used during the growing season.
5. For the banana bacterial wilt strain No. 2, the exporting orchards should establish a non-infected area (PFPP) in accordance with the 10th Standard for International Phytosanitary Measures. Once symptoms related to the banana bacterial wilt strain No. 2 are found in the orchard, integrated pest management measures must be implemented to eradicate the pest. The non-infected area can only be restored if there are no records of the pest for six months.
6. Regarding other quarantine pests such as aphids and scale insects that China is concerned about, orchard monitoring must be conducted. From the banana flowering period to the harvest period, monitoring should be carried out once every 15 days. If any pests or their corresponding symptoms are found during the monitoring process, comprehensive management measures including chemical, physical or biological control methods should be taken to ensure that the exported bananas do not carry these quarantine pests. The monitoring and control activities are implemented by the producers and supervised by the Ministry of Agriculture.
(II) Packaging Factory Management.
The processing, packaging, storage and transportation of bananas exported to China must be carried out under the supervision of the secretariat.
2. During the processing and packaging stage, bananas should undergo procedures such as soaking and water washing, manual sorting, and grading to ensure that they do not contain insects, mites, snails, rotten fruits, grass seeds, plant residues, or soil.
3. If the packaged bananas need to be stored, they should be immediately placed in the warehouse and stored separately to prevent re-infection by harmful organisms.
4. The packaging factory should establish a traceability system to ensure that the bananas exported to China can be traced back to the registered orchard. It should record the processing and packaging date, the name or registration number of the source orchard, the quantity of bananas, the export date, the export quantity, the destination country, the vehicle or container number, the seal number, etc. If chemicals are used during the processing, the names of the chemicals, their active ingredients, dosages, and the date of use should also be recorded. The records should be kept for at least two years.
(III) Packaging Requirements.
1. The packaging materials should be clean, hygienic and unused, and should comply with the relevant plant quarantine and hygiene requirements of China. If wooden packaging is used, it must meet the requirements of International Standard for Phytosanitary Measures No. 15.
2. Each packaging box must be marked with the name of the fruit, the exporting country, the place of origin (province or city), the orchard and the packaging factory name and registration number in Chinese or English. Each packaging box and pallet should be marked in Chinese or English with "Exported to the People's Republic of China".
3. The containers or sealed vehicles carrying bananas for export to China should be clean and hygienic, and should be affixed with seals. When arriving at the Chinese entry port, the seals should remain intact and undamaged.
(4) Pre-export inspection and quarantine.
During the first two years of trade, samples should be taken from the bananas exported to China at a rate of 2% per batch. If no plant quarantine issues occur within these two years, the sampling rate can be reduced to 1%.
2. If any quarantine pests or soil of concern to the Chinese side are found, the entire batch of goods shall not be exported to China. The secret formula should investigate the cause and take improvement measures. At the same time, relevant records should be kept and should be provided to the Chinese side upon request.
(5) Requirements for Plant Quarantine Certificates.
For bananas that have passed quarantine inspection, the manufacturer should issue a phytosanitary certificate in accordance with the relevant provisions of International Standard for Phytosanitary Measures No. 12, indicating the name or registration number of the orchard and packaging plant. Additionally, in the supplementary statement, it should be noted: "This consignment complies with the requirements specified in the Protocol of Phytosanitary Requirements for the Export of Fresh Banana Fruits from Peru to China, and is free from quarantine pests of concern to China."
VII. Import Inspection and Quarantine and Handling of Non-conformities
When bananas exported to China arrive at the Chinese entry ports, the Chinese customs will conduct inspection and quarantine in accordance with the following requirements.
(1) Verification of certificates and labels.
1. Verify whether the imported bananas have obtained the "Entry-Exit Animal and Plant Quarantine Permit".
2. Verify whether the phytosanitary certificate complies with the provisions of item (5) of Article 6 of this announcement.
3. Verify whether the labels on the packaging boxes and pallets comply with the provisions of Item (3) of Article 6 of this announcement.
(2) Import Inspection and Quarantine.
Bananas exported to China should enter the country through the ports where China permits the import of fruits.
2. In accordance with Chinese laws and regulations, as well as national standards, inspections and quarantines will be carried out. Those that pass the inspections and quarantines will be permitted to enter the country.
(3) Handling of Nonconformities.
1. If it is found that the goods come from orchards or packaging factories that have not been approved by China, then such goods are not allowed to enter the country.
2. If any ripe bananas or those with cracked skins are found, the aforementioned bananas should be returned for reprocessing or destroyed.
3. If the banana bacterial wilt strain No. 2 is detected, the entire batch of goods will be returned or destroyed.
4. If any other quarantine pests of concern to China or any new quarantine pests occurring in Peru are found alive in the goods, or if any branches, leaves or soil are found, the goods will be returned, destroyed or subject to pest control treatment.
5. If any goods are found to be in violation of China's food safety laws and regulations or national standards, the entire batch of goods will be returned or destroyed.
