General Administration of Customs Announcement No. 73 of 2024 (Announcement on Phytosanitary Requirements for the Import of Fresh Kiwifruit from New Zealand)

According to the relevant laws and regulations of China and the provisions of the General Administration of Customs of the People's Republic of China and the Ministry of Primary Industry of New Zealand on the phytosanitary requirements of New Zealand fresh date kiwifruit exported to China, from now on, the import of New Zealand fresh date kiwifruit that meets the following relevant requirements is allowed.

 

I. Basis for inspection and quarantine

 

(1) The Biosafety Law of the People's Republic of China;

 

(2) The Entry-Exit Animal and Plant Quarantine Law of the People's Republic of China and the Regulations for its implementation;

 

(3) The Food Safety Law of the People's Republic of China and its implementing regulations;

 

(4) Measures for the Supervision and Administration of Inspection and Quarantine of Imported Fruits;

 

(5) The Export Plan of the General Administration of Customs of the People's Republic of China and the Ministry of Primary Industries of New Zealand on Plant Quarantine Requirements for New Zealand Fresh Jujube Kiwifruit exported to China.

 

2. Names of goods allowed to enter the country

 

Fresh Actinidia arguta (hereinafter referred to as Actinidia arguta), English name kiwiberry.

 

3. Permissible origin

 

New Zealand jujube kiwifruit producing area.

 

4. Approved orchards and packaging plants

 

Kiwifruit orchards and packaging plants exported to China shall be reviewed and filed with the Ministry of Primary Industries of New Zealand (hereinafter referred to as the New Zealand side) and approved for registration by the General Administration of Customs of the People's Republic of China (hereinafter referred to as the Chinese side). The registration information should include the name, registration number and address (region or region) of the orchard and packing plant, so as to accurately trace the export goods if they do not comply with the relevant regulations. Before the annual export season, the New Zealand side shall provide the Chinese side with the list of orchards and packaging plants, which shall be published on the website of the General Administration of Customs after approval by the Chinese side.

6. Pre-export management

 

(1) Orchard management.

 

1. Orchards exported to China should implement Good Agricultural practices (GAP) and integrated pest management (IPM), including monitoring and investigation of quarantine pests of concern to the Chinese side, and take necessary chemical, agricultural or biological control measures.

 

2. The monitoring, investigation and control of pests in orchards exported to China shall be carried out under the guidance of Singapore officials or technicians trained by their authorized institutions. Integrated pest management measures shall be approved by Singapore and made available to China upon request.

 

3. Orchards exported to China shall keep records of monitoring, investigation and control of quarantine pests of concern to the Chinese side, including detailed information such as the name, active ingredient, date of use and concentration of all chemical agents used during the growing season, and shall provide them to the Chinese side upon request.

 

4. For kiwi fruit rot pathogen, the New Zealand officials or their authorized personnel shall take samples of Kiwi jujube for phytosanitary inspection at the standard sampling size of New Zealand, with a minimum sampling size of 600 fruits. If the pathogen is found, kiwifruit from the exported orchard shall not be exported to China during the rest of the export season.

 

(2) Packaging plant management.

 

1. The processing, packaging, storage and transportation of kiwifruit exported to China shall be carried out under the supervision of Singapore.

 

2. Before packaging, kiwifruit should be graded, sorted and inspected to ensure that it is free of insects, mites, diseased fruit, deformed fruit, leaves, roots and soil.

 

3. Kiwifruit exported to China should be packaged and stored separately from kiwifruit that do not meet the requirements for export to China to avoid infection with harmful organisms.

 

(3) Packaging requirements.

 

1. The packaging materials of kiwifruit exported to China should be clean, sanitary and unused, and meet the requirements of plant quarantine and hygiene of China. If wood packaging is used, it must comply with International Standard for Phytosanitary Measures 15 (ISPM 15).

 

2. The registered name or number of the fruit type, country of export, orchard and packing plant shall be marked on each packing case in Chinese or English. Each pallet shall be marked with the following words: "Exported to the People's Republic of China" or "Exported to the People's Republic of China" in Chinese or English. The same mark should be used on the packing cases without pallets.

 

(4) pre-export inspection and quarantine.

 

1. Kiwifruit exported to China shall undergo an adequate level of phytosanitary inspection in accordance with the standard inspection procedures in the New Zealand export Certification System to ensure that the quarantine requirements for quarantine pests of concern to the Chinese side are met.

 

2. If plant inspectors approved by Singapore or qualified plant inspectors find live quarantine pests of concern to the Chinese side, the whole batch of goods shall not be exported to China. Until the cause is identified and corrective measures are taken, in some cases, the relevant orchards and packaging plants are not allowed to export to China for the rest of the export season.

 

3. The New Zealand approval authority shall keep all inspection records and provide them to the Chinese side upon request.

 

(5) Requirements for plant quarantine certificates.

 

1. Kiwifruit that has passed quarantine shall be issued by Singapore with a phytosanitary certificate indicating the orchard registration number, the packing plant registration number and the container seal identification number (if used). The orchard and packing plant registration number of each shipment may be indicated on the attached page of the phytosanitary certificate.

 

2. The phytosanitary certificate shall include the following additional declaration: “This consignment is in compliance with the requirements specified in the Export Plan for Export of Fresh Kiwiberry  fromNew Zealand to China, and is free from any quarantine pests of concern to China. "(The goods meet the requirements of New Zealand's kiwifruit export program to China. No quarantine pests of concern to China.)

 

Vii. Entry quarantine and nonconformity treatment

 

When kiwifruit exported to China arrives at the entry port of China, the Chinese Customs shall conduct inspection and quarantine in accordance with the following requirements.

 

(1) Verification of relevant certificates and identification.

 

1. Check whether the imported fruit has obtained the Entry Plant and Animal Quarantine Permit.

 

2. Check whether the plant quarantine certificate conforms to the provisions of Article 6 (5) of this announcement.

 

3. Check whether the marks on the packing boxes and pallets (if used) comply with the provisions of Article 6 (3) of this announcement.

 

(2) Entry inspection and quarantine.

 

1. Kiwifruit exported to China shall be imported from ports that allow the import of fruits.

 

2. In accordance with relevant laws, administrative regulations, rules and other provisions, the inspection and quarantine of imported Chinese kiwifruit shall be carried out, and those that pass the inspection and quarantine shall be allowed to enter the country.

 

(3) unqualified treatment.

 

1. If it is found that kiwifruit is from unregistered orchards and packaging factories, the goods are not allowed to enter the country.

 

2. If any living quarantine pests of concern to China are found, the goods shall be returned, destroyed or disposed of. The Chinese side will immediately inform the New Zealand side and, depending on the situation, decide whether to suspend the import of kiwifruit from the relevant orchards and packaging plants for the rest of the export season. The New Zealand side should immediately carry out an investigation to find out the cause and take corresponding improvement measures to avoid the recurrence of such a situation. China will decide whether to lift the suspension measures based on the results of its assessment of the improvement measures taken by Singapore.

 

3. If any other living quarantine pests of concern to China are found, the goods shall be returned, destroyed or disposed of. The Chinese side will immediately notify the New Zealand side, and the New Zealand side should conduct an investigation to find out the cause and take corresponding improvement measures to avoid the recurrence of such a situation.

 

4. If it is found that the goods do not meet the national food safety standards of China, the goods shall be returned or destroyed.
