Tomato brown rugose fruit virus (ToBRFV) is a plant virus that damages Tomato, pepper and other solanaceae crops. It can cause yellow macula, malformation, Browning, necrosis and other symptoms of leaf Mosaic, fern leaf and fruit, seriously affecting fruit yield and quality, with great harm. It can be transmitted along with seeds for a long distance and is a legal plant quarantine pest in China. In order to prevent the introduction of the virus and protect China's agricultural production and ecological security, in accordance with the Biosafety Law of the People's Republic of China, the Law of the People's Republic of China on the Entry and Exit Animal and Plant Quarantine and its implementation Regulations and other relevant laws and regulations, as well as relevant international standards for plant quarantine measures, The requirements for source control and quarantine of imported tomato (Solanum lycopersicum) and Capsicum SPP. Seeds are hereby announced as follows:

  1. If there is no occurrence of tomato brown wrinkled fruit virus in the country or region of origin, the competent department of plant quarantine shall indicate in the additional statement of the plant quarantine certificate issued: "This consignment of seeds is originated from___ (country or area),where is free of ToBRFV. "[these seeds were produced in ___ (countries or areas) without occurrence of tomato brown wrinkled fruit virus. :

  2. If tomato brown wrinkled fruit virus occurs in the country or region of origin, but comes from the tomato brown wrinkled fruit virus non-epidemic area established according to the International Standard for Phytosanitary Measures No.4 "Requirements for The Establishment of Non-epidemic Area" (ISPM No.4), the competent phytosanitary authority shall indicate in the additional statement of the phytosanitary certificate issued by the phytosanitary authority: "This consignment of seeds is originated from pest free area for ToBRFV."

  Three, such as originated from countries or regions have tomato brown wrinkle fruit viruses, and has not been established an epidemic area, plant quarantine departments should implement the field survey, confirmed its gardens in growth period, there was no tomatoes brown wrinkle fruit virus, and before the export of the group of at least 3000 grain seed extract (10%) small batch seed at least representative samples. No tomato brown wrinkled fruit virus was detected by RT-PCR or real-time fluorescence RT-PCR. The competent department of plant quarantine shall indicate in the statement attached to the plant quarantine certificate: "The Field survey was carried out during the growth period of this consignment of seeds, no ToBRFV occurred in the planting area. Prior to export, This consignment of seeds has been tested by RT-PCR (or real-time RT-PCR) and found free of ToBRFV. Tomato brown wrinkled fruit virus did not occur in the planting area. The seeds were detected by RT-PCR (or real-time fluorescent RT-PCR) before export without tomato brown wrinkled fruit virus. :

  For seeds harvested before January 1, 2022, they are exempt from field investigation requirements and should be indicated in the additional declaration of plant Quarantine certificate: "This consignment of seeds was 133 before January 1st, 2022, Tested by RT-PCR (or real-time RT-PCR) prior to export, and found free of ToBRFV." No tomato brown wrinkled fruit virus was detected by RT-PCR (or real-time fluorescent RT-PCR) before export. :

  4. Tomatoes and capsicum seeds exported to China through a third country or region shall be accompanied with the original phytosanitary certificate issued by the competent phytosanitary authority of the country or region of origin with corresponding additional statements in accordance with the requirements of The Phytosanitary Certificate (ISPM No.12) of the International Standard for Phytosanitary Measures. Or a copy confirmed by the plant quarantine authority of a third country or region, and at the same time:

  (1) If the seeds are only stored or assembled with other goods in a third country or region and are not contaminated by harmful organisms, the plant quarantine authority of the third country or region shall issue a plant quarantine certificate for re-export.

  (2) If the batch of seeds are contaminated by harmful organisms, the competent plant quarantine authority of a third country or region shall carry out pre-export testing and issue a plant quarantine certificate indicating in the additional declaration: "Prior to export, this consignment of seeds has been tested by RT-PCR (or real-time RT-PCR), The seeds were detected by RT-PCR (or real-time fluorescent RT-PCR) before export and were free of tomato brown wrinkled fruit virus. :

  The customs shall examine the phytosanitary certificates attached to imported tomato and pepper seeds and carry out quarantine on the goods. If the certificates do not meet the requirements or the tomato brown wrinkled fruit virus is detected, the customs shall return or destroy the certificates according to law.

  Vi. This announcement shall come into force as of January 1, 2022.
